HPV Vaccine Lawsuit
HPV, human papillomavirus, is a common sexually transmitted infection. In fact, HPV is the most common sexually transmitted infection. Merck developed a vaccine to protect people from HPV. But, undisclosed side effects have led to HPV vaccine lawsuits. Have you been harmed by this vaccine? Do you have an HPV vaccine lawsuit? Learn more in this article.
What Is HPV?
HPV, or human papillomavirus, is a sexually transmitted infection (STI). Symptoms include genital warts and warts on the surrounding skin. Many sexually active men and women will be infected with HPV at some point in their lives. Some people even become infected multiple times. There are more than 3 million cases of HPV reported each year.
How Is HPV Spread?
HPV spreads through sexual contact. It can even spread from a mother to her baby by pregnancy, during labor, or nursing. Penetrative sex is not required in order for transmission of the virus, and asymptomatic people may transmit the virus as well.
There is no cure for the virus, and it usually goes away on its own over time. However, in more rare cases the virus may lead to cancer. There are over 100 variations of this virus, and at least 14 of the variants are known to cause cancer.
Prevention is the best way to avoid infection. Merk developed Gardasil, an HPV vaccine to protect people from infection. The vaccine consists of two doses, spaced six months apart. Gardasil is the only HPV vaccine available in the United States that is approved by the FDA.
The CDC recommends HPV vaccination at age 11 or 12, before becoming sexually active. The vaccine is meant to prevent sexually active individuals from becoming infected with HPV and potentially developing cancer as a result of the virus. The CDC states that the available vaccines are safe with no serious side effects. However, there have been cases of teens and adults becoming seriously injured as a result of the vaccine.
Gardasil HPV Vaccine Lawsuit
Merck, the manufacturer of the Gardasil vaccine, is being sued under claims that the company misled the FDA. The company hid information about the safety and effectiveness of its vaccine. There are several lawsuits currently filed on behalf of those harmed by Gardasil.
Important Notice About The HPV Vaccine
It is important to know that not everyone that receives Gardasil experiences dangerous side effects. But, some people do experience dangerous side effects. Warnings about these potential health problems were not disclosed to people and parents interested in the HPV vaccine.
Vaccines Are Important To Public Health
Vaccines are important to public health, but companies must disclose information about all known side effects. This failure to disclose known potential health problems doesn’t allow patients to make a fully informed decision about their healthcare. When people know the benefits and risks of a specific vaccine, they can make the best decisions for their personal health.
First HPV Vaccine Lawsuit
One lawsuit is filed on behalf of Julia B., a 19-year-old that she suffers severe and permanent injuries from Gardasil. Additionally, she has developed an autoimmune disease, postural orthostatic tachycardia syndrome (POTS), after receiving the Gardasil vaccine. Her injuries were so severe and debilitating that she was unable to attend school. The lawsuit is seeing punitive damages against Merck.
The lawsuit is suing Merck on the following claims:
- strict liability (failure to warn)
- breach of warranty
- common law fraud
More People File HPV Vaccine Lawsuits
This 19-year-old is not the only person suing Merck with an HPV vaccine lawsuit. Other individuals who have received the Gardasil vaccine have stepped forward. They have also developed an autoimmune disease following the injection of the HPV vaccine. Additionally, other people have suffered seizures, vertigo, double vision, balance problems as well as anxiety, and other health problems.
Failure To Warn
People who have received the Gardasil vaccine have not been properly warned of the potential side effects and health issues. Merck was negligent in failing to protect and warn the users of the potential dangers. Many individuals are now suffering at the hands of the Gardasil vaccine. Would they choose Gardasil if they knew all the potential health problems?
