Later, in the 3rd Circuit Court of Appeals in Philadelphia, Heather won a victory. The court found Amazon plays a large part in the entire sales process. The 3rd Circuit sent the case back to the lower court. The lower court must hear the case against Amazon.
Often, Amazon stores and ships products “sold” by third-party sellers. And, customers must use Amazon’s website to communicate with sellers. Plus, Amazon makes it hard to find information for sellers on its website. As such, many believe Amazon owes a duty to customers.
