Amazon Product Injury
Dangerous Products Sold On Amazon
Buying products on Amazon can be an effective way to save money. When something goes wrong and a defective product causes injury, you need help. An Amazon product injury lawyer may be able to help.
Amazon Product Injury
Heather Oberdorf purchased a retractable dog leash on Amazon. But, on Amazon, the “seller” was The Furry Gang. While using the retractable leash, it broke and hit Heather in the eye. This caused permanent blindness in Ms. Oberdorf’s one eye.
The Seller Disappeared
Heather tried contacting the seller through Amazon. But, she didn’t get a response. She was left with a permanent injury and medical bills caused by a defective product.
Amazon Denied Liability
Even though Heather bought her product through Amazon, Amazon denied any responsibility for the injury. They were also unable to locate the seller for Heather. She filed a lawsuit against Amazon for the defective product. But, Ms. Oberdorf lost in court against Amazon.
Later, in the 3rd Circuit Court of Appeals in Philadelphia, Heather won a victory. The court found Amazon plays a large part in the entire sales process. The 3rd Circuit sent the case back to the lower court. The lower court must hear the case against Amazon.
Often, Amazon stores and ships products “sold” by third-party sellers. And, customers must use Amazon’s website to communicate with sellers. Plus, Amazon makes it hard to find information for sellers on its website. As such, many believe Amazon owes a duty to customers.
When To Call An Amazon Product Injury Lawyer
It’s important to remember, not every situation is the same. So far, the court has only agreed that the case must be heard. This case has not been won yet. Additionally, this ruling only applies to Pennsylvania.
