Gas Well Ordinance empowers Impact Fees

Under Act 13, the 2012 Oil and Gas Title 58 policy, Perry County commissioners have adopted an ordinance that will impose an unconventional gas well fee so one will be in place should any wells be established in the country. Currently, there are no such wells in the county but that does not mean that there will not be in the near future as several nearby and bordering counties currently have some. This ordinance amends the Oil and Gas Title 58 and reenacts relevant parts of the Oil and Gas Act relating to municipal zoning and land uses.

According to a County Commissioners Association of Pennsylvania document, “a county with unconventional gas wells that fails to adopt the fee is prohibited from receiving fee revenues and from receiving revenues from statewide initiatives until the year following its levy of the fee.” The aforementioned fee is based on a sliding scale, based on 15 years for each well, and is based on the current average price for natural gas. Fees are collected and deposited in an Unconventional Gas Well Fund minus some distributions to county conservation districts and state agencies.

Mayors hit Bill to Limit Local Gun-control

Several Pennsylvania mayors argued that a proposed bill would make it easier for gun-rights activists to challenge local gun-control laws in an attempt to bully local municipalities into repealing current ordinances that require gun owners to report lost or stolen guns.

In a small step toward preventing violent crimes that involve lost or stolen guns, mayors or surrogates from Philadelphia, Allentown, Pittsburgh, Chester and Lancaster defended the reporting requirement. Philadelphia Mayor, Michael Nutter, added that 85% of the over three hundred homicides in Philadelphia in 2011 were with guns, all of which were illegal. Lancaster Mayor, Richard Gray, backed Nutter saying ”If the General Assembly won’t do it, then they ought to leave it up to us at the local level to take care of it.”

If the challenge is successful, a judge could fine each municipality $5,000 and award the plaintiffs payments for damages and legal expenses. The bill, which is pending in the Pennsylvania House of Representatives. In June of 2010, the Pennsylvania Supreme Court upheld the reporting requirement but threw out all ordinances that were to limit people to one gun purchase each month and banned assault weapons.

Pennsylvania Judge charged over dismissing own Traffic Tickets

District Judge Kelly S. Ballentine has been removed from the bench and charged with numerous criminal offenses of allegedly dismissing three traffic tickets issued to her. Two of these alleged tickets were parking violations and the third was issued for an expired registration.

After failing to pay either of the three tickets it is believed that she accessed teh court’s computers and dismissed the summonses. There were twelve charges filed against Ballentine that include conflict of interest, obstructing the administration of law, tampering with public records. She has since posted $25,000 bail and was released. Her court hearing is scheduled for February 23.

Trucking Traffic may lead to Problems

Over the past four years, truck traffic has increased 20 fold in Waynesburg, a county seat between Pittsburgh, Pennsylvania and Morgantown, West Virginia. And while traffic has led to local small business and township prosperity, it has also lead to damaged roads, sidewalks, streetlights and fire hydrants. Waynesburg mayor, Blair Zimmerman tells about trucks driving over the speed limit as 70 miles per hour and running through red lights.

While Zimmerman notes that the gas and oil industry operators in his town have lead to increased business in the restaurant, clothing store, and car dealership industries, it is costing the town and its residents money. Because of the increased traffic Waynesburg quickly enacted an ordinance that requires vehicles to park as close to the curb as possible because many vehicles were losing driver’s side mirrors.

Whitpain Township Passes Billboard Ordinance

Whitpain Township is the most recent to follow other municipalities across the state of Pennsylvania in approving a zoning ordinance that will allow billboards along certain areas of the Pennsylvania Turnpike. While the township will allow billboards, it has taken measures to reduce the negative effects of the signs including restricting the times when lighted billboards can be used and limiting the size of each advertisement.

While the township has been fortunate in avoiding challenges to their previous zoning ordinance, they believe the new revision will hold up against any challenge in the future.
